Andersen in Palestine has successfully concluded a project in collaboration with the Palestinian Capital Market Authority, encompassing the completion of a comprehensive technical and legal study evaluating the status of the financial leasing sector in Palestine. The project also involved the formulation of five legislative proposals, namely: a draft decree-law governing factoring activities, the Financial Leasing Regulations, proposed instructions for Islamic financial leasing, a draft of regulations outlining penalties and fines for non-compliance with financial leasing regulations and instructions, and proposed instructions pertaining to the registration of immovable property leased for financial leasing purposes.
The achievement of this project was made possible through the dedicated efforts of a local and regional team, led by Mahmoud Abu Sway, the main researcher and the leader of the research team and project. The research team included esteemed professionals such as attorney Bashir Assi, Professor Mahmoud Alawneh, attorney Yara Abu Meizer attorney Tasnim Kahla, Enas Natsheh, and Vivian Reyad Riad. Additionally, consultant experts from Jordan and Saudi Arabia, notably Attorney Azzam Zaloum, contributed significantly to the project's success.
This undertaking aligns with the responsibilities of the company's studies department and underscores its commitment to delivering diverse legal services aimed at advancing the legal framework in Palestine. The initiative reflects adherence to best practices, drawing insights from regional and international experiences to address the current needs of the local context.
أنهت شركة أندرسن - فلسطين، مشروعاً مع هيئة سوق رأس المال الفلسطينية، تضمّن إعداد: "دراسة فنية وقانونية لمراجعة وضع قطاع التأجير التمولي في فلسطين"، بالإضافة إلى إعداد خمسة مقترحات تشريعية تمثلت ب: مشروع قرار بقانون بشأن تنظيم نشاط التخصيم؛ مشروع نظام التأجير التمويلي؛ مقترح تعليمات التأجير التمويلي الإسلامي؛ مشروع نظام العقوبات والغرامات لمخالفة أنظمة وتعليمات التأجير التمويلي؛ مقترح تعليمات بشأن تسجيل المال غير المنقول المؤجر تأجيراً تمويلياً. شارك في هذا إنجاز هذا المشروع فريق عمل محلي وإقليمي ضم: د. محمود أبوصوي (باحثاً رئيسياً ومشرفاً على الفريق البحثي والمشروع)، وفريق بحثي مكون من: الأستاذ بشير عاصي، الأستاذ محمود علاونة، الأستاذة يارا أبو ميزر، الأستاذة تسنيم كحلة، الأستاذة إيناس النتشة، الأستاذة فيفيان رياض. وبمشاركة خبراء استشاريين من الأردن والسعودية: أبرزهم الأستاذ المحامي عزام زلوم. تأتي هذه الدراسة كجزء من مهام قسم الدراسات لدى الشركة، وفي إطار اهتمامها بتقديم الخدمات القانونية المختلفة لتطوير البنية القانونية في فلسطين؛ بما يتوافق مع الممارسات الفضلى على ضوء التجارب الإقليمية والدولية واحتياجات الواقع.
